Warranty Claim Policy
1. Warranty Coverage
This limited warranty (the “Warranty”) is provided by SWISHGRID to the original purchaser of a new or factory-refurbished product purchased directly from us or an authorized retailer. The Warranty covers defects in materials and workmanship under normal use and maintenance. It is not transferable to subsequent purchasers and does not apply to products purchased from unauthorized sources.
2. Warranty Period
The Warranty period begins from the date of purchase and varies by product category:
- Basketball Hoops: 1 year
- Rebounding Machines & Shot Trainers: 1 year
- Other Equipment: 6 months
3. Eligibility
To be eligible for a warranty claim, the following conditions must be met:
- The product must be purchased directly from SWISHGRID or an authorized retailer.
- Proof of purchase is required.
- The claim must be made within the warranty period.
4. What This Warranty Covers
We warrant that the product is free from defects in materials and workmanship and will perform substantially by our product documentation and specifications. This Warranty covers:
- Defects in materials and workmanship
- Coverage for parts and standard domestic shipping of said parts (labor not included)
5. What This Warranty Does Not Cover
The Warranty does not cover:
- Normal wear and tear
- Damage from misuse, accident, neglect, abuse, alteration, unauthorized modification, or tampering
- Damage to property, home, walls, or floors from installation or removal
- Products resold or altered from their original state
- Damage caused by improper maintenance, installation, relocation, or uninstallation
- Shipping or delivery damage
- Software or software functionality issues
6. How to Make a Warranty Claim
To submit a warranty claim:
1. Contact Us: Email us at [sg@swishgrid.com], or use our Warranty Claim Form. Provide your proof of purchase and a description of the issue.
2. Assessment: We may request additional information or photos.
3. Return Instructions: If your claim is approved, we will issue a Return Material Authorization (RMA) number and provide return instructions.
7. Resolution Options
Upon receipt of the returned product, we will:
Repair: Repair the product if feasible (labor not included).
Replace: Replace the defective product with a new or factory refurbished unit.
Refund: Offer a refund if repair or replacement is not possible.
8. Legal Information
The laws of the State of California, USA, govern this warranty, without giving effect to any conflict of laws or principles that may provide the application of the law of another jurisdiction.
Swishgrid expressly disclaims any and all other warranties, both express and implied, including any warranty of merchantability or fitness for a particular purpose.
Swishgrid and any third-party service providers or suppliers shall not be liable for performance deficiencies caused or created by you or others you allow to use the product. Swishgrid does not warrant that its equipment’s performance will be uninterrupted, error-free or completely secure. Swishgrid and any third-party providers or suppliers shall not be liable for service interruptions caused by failure of equipment, other software or services not provided by Swishgrid or its third-party providers or suppliers, or failure of communications, power outages, or other interruptions not within the complete control of Swishgrid or its providers or suppliers, even if Swishgrid or its third-party providers or suppliers know or have been advised of the possibility of such loss. In the event of any system error or omission, the sole obligation of Swishgrid shall be to process a correction of the error or omission as reasonably necessary.
Swishgrid does not assume any liability for any special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, including but not limited to loss of profits or revenues, loss of data, loss of use of the product, cost of replacement or substitute items, or loss of use during the period that the product is being replaced or repaired. Further, Swishgrid shall not be liable to you for any special, consequential, incidental, indirect, or punitive damages of any kind whatsoever, even if Swishgrid has been advised as to the possibility of such damages, for any claim arising from or related to this warranty statement, regardless of the form of action, whether in contract, tort (including negligence), product liability, lost revenue, lost profit, lost data, or privacy, or any other cause of action or legal or equitable theory. In no event shall Swishgrid’s liability for any claim arising out of or related to this warranty exceed the price paid by you for purchase of the product, regardless of the form of action, whether in contract, tort (including negligence), product liability, lost revenue, lost profit, lost data, or privacy, or any other cause of action or legal or equitable theory.
